These Terms and Conditions ("Terms") govern your use of the TalkTake mobile application, website, and related services. TalkTake is operated by TalkTake. By using TalkTake, you agree to these Terms.
1. About TalkTake
TalkTake is a content-creation application that may provide features including:
- AI-assisted script generation
- Manual script creation
- Script editing
- Voice input
- Voice-follow teleprompter
- Camera recording
- Video preview
- Local video storage
- Video export
- Script and video organization
Features may change over time.
2. Eligibility
You must be legally permitted to use TalkTake under the laws applicable to you. If you are under the legal age required to agree to these Terms, you must have permission from a parent or legal guardian where required.
3. Your Account
You are responsible for:
- Providing accurate account information
- Maintaining access to your email account
- Keeping your account secure
- Activities performed through your account
You must notify us if you believe your account has been accessed without authorization.
4. Acceptable Use
You must not use TalkTake to:
- Break applicable laws
- Harass, threaten, or abuse others
- Create fraudulent or deceptive content
- Violate another person's intellectual-property rights
- Distribute malware or harmful software
- Attempt to interfere with TalkTake's systems
- Reverse engineer or improperly access protected parts of the service
- Use TalkTake for unlawful or harmful activity
We may restrict or terminate accounts involved in serious misuse.
5. Your Content
You retain ownership of content you create or upload to TalkTake, including your:
- Ideas
- Scripts
- Recordings
- Videos
- Text content
You give TalkTake only the permissions reasonably necessary to process your content and provide the features you request. For example, if you ask TalkTake to create an AI script, we may process your submitted idea to generate that script.
6. AI-Generated Content
TalkTake may use artificial intelligence to create or modify scripts. AI-generated content may occasionally:
- Be inaccurate
- Contain errors
- Be incomplete
- Produce unexpected results
- Be similar to content generated for other users
You are responsible for reviewing AI-generated content before publishing or relying on it. TalkTake does not guarantee that AI-generated content is factually accurate, unique, legally safe, or suitable for a particular purpose.
7. Intellectual Property
The TalkTake application, branding, logo, interface, software, designs, and related materials belong to TalkTake or its licensors. You may not copy, distribute, sell, modify, or reproduce TalkTake's proprietary materials except where permission is provided. These Terms do not transfer ownership of TalkTake intellectual property to you.
8. Recording and Consent
You are responsible for ensuring that you have permission to record:
- Other people
- Private locations
- Copyrighted material
- Events or conversations
Recording laws differ between countries and regions. TalkTake is only a recording tool and is not responsible for how you use recordings.
9. Local Video Storage
Videos may be stored locally on your device. You are responsible for maintaining backups of important recordings. Deleting the app, clearing application storage, resetting your device, or losing your device may result in locally stored videos being permanently lost. TalkTake does not guarantee recovery of locally stored content.
10. App Permissions
Some features require access to your:
- Camera
- Microphone
- Photos or media library
If you deny these permissions, certain TalkTake features may not function.
11. Paid Features and Subscriptions
If TalkTake offers paid features, subscriptions, or in-app purchases, pricing will be shown before purchase. Purchases may be processed through Apple App Store or Google Play. Payments, renewals, cancellations, and refunds may also be subject to the terms of the applicable app store.
12. Third-Party Services
TalkTake may rely on third-party providers for:
- AI services
- Email delivery
- Cloud infrastructure
- Speech recognition
- Analytics
- App-store payments
Use of those services may also be subject to their terms and privacy policies.
13. Availability
We aim to keep TalkTake available and reliable, but we do not guarantee that:
- The app will always be available
- Every feature will always work
- The service will be free from errors
- AI or speech recognition will always be accurate
- All devices will behave identically
We may update, modify, suspend, or discontinue features where necessary.
14. Disclaimer
TalkTake is provided on an "as is" and "as available" basis to the extent permitted by law. TalkTake is a creator productivity tool. We do not guarantee specific:
- Audience growth
- Views
- Followers
- Revenue
- Social-media performance
- Business results
Your results depend on many factors outside TalkTake's control.
15. Limitation of Liability
To the maximum extent permitted by law, TalkTake will not be responsible for indirect, incidental, special, or consequential losses arising from your use of TalkTake. This may include losses related to:
- Lost recordings
- Lost scripts
- Device problems
- Incorrect AI output
- Failed uploads or exports
- Content publication
- Loss of income or opportunities
Nothing in these Terms excludes liability that cannot legally be excluded.
16. Account Suspension or Termination
We may suspend or terminate access where a user:
- Seriously violates these Terms
- Uses TalkTake unlawfully
- Attempts to damage the service
- Abuses other users or systems
- Engages in fraud
You may stop using TalkTake at any time.
17. Changes to TalkTake
We may add, remove, or update features as the product develops. Some features described today may change in future versions.
18. Changes to These Terms
We may update these Terms when TalkTake or applicable laws change. The updated Terms will display a revised effective date. Continuing to use TalkTake after an update may mean you accept the revised Terms where legally permitted.
19. Governing Law
These Terms are governed by the laws of the applicable jurisdiction, unless applicable consumer law requires otherwise. Any disputes will be handled according to applicable law.
